Үкімнің заңды күшіне енуі және оны орындауға енгізу

Бірінші сатыдағы соттың үкімдері, егер оларға шағым жасалмаса немесе наразылық білдірілмесе, апелляциялық шағым жасау немесе наразылық білдіру мерзімі өткен соң заңды күшіне енеді және орындауға енгізуге жатады. Егер іс апелляциялық сатыда қайта қаралған жағдайда, үкімнің күші жойылмаса, ол апелляциялық қаулы шығарылған күні күшіне енеді. Егер апелляциялық шағымдар, наразылық апелляциялық сатыдағы сот отырысы басталғанға дейн кері қайтарып алынса, апелляциялық саты шағымның, наразылықтың кері қайтарып алуына байланысты іс жүргізуді тоқтата тұру қаулы шығарған күні үкім заңды күшіне енеді. Бірінші сатыдағы сот, үкімнің заңды күшіне енген немесе іс жоғары тұрған соттан қайтарылған күннен бастап үш тәуліктен кешіктірмей үкімді орындауға енгізеді.

         ҚР ҚПК-нің 472-бабына сәйкес, соттың заңды күшiне енген үкiмi мен қаулысы мемлекеттiк органдардың, жергiлiктi өзiн-өзi басқару органдарының, заңды тұлғалардың, лауазымды адамдардың, азаматтардың бәрiне бiрдей мiндеттi және Қазақстан Республикасының бүкiл аумағында бұлжытпай орындалуға жатады. Соттың үкiмiн, қаулысын орындамау қылмыстық жауаптылыққа әкеп соғады.

Үкiмді орындауға енгізу iстi бiрiншi саты бойынша қараған сотқа жүктеледi. Үкiмдi орындау туралы өкiмдi судья үкiмнiң көшiрмесiмен бiрге қылмыстық-атқару заңнамасына сәйкес үкiмдi орындауға келтіру мiндетi жүктелген органға жiбередi. Апелляциялық сатыдағы сотқа күзетпен ұсталып отырған адамдарға қатысты iстi апелляциялық қарау нәтижелерiн хабарлау мiндетi жүктеледi. Iстi апелляциялық тәртiппен қарау кезiнде үкiм өзгертілген жағдайда, үкiмнiң көшiрмесiне апелляциялық саты қаулысының көшiрмесi қоса берілуге тиiс. Егер үкiмде сотталған адамды Қазақстан Республикасының мемлекеттiк наградасынан, Қазақстан Республикасының Президентi берген құрметтi, әскери, арнаулы немесе өзге де атағынан, сыныптық шенiнен, дипломатиялық дәрежесінен немесе бiлiктiлiк сыныбынан айыру туралы мәселенi қою қажеттiгi көрсетiлсе, онда үкiмдi шығарған сот Қазақстан Республикасының Президентiне сотталған адамды мемлекеттiк наградасынан, көрсетiлген атақтарынан, сыныптық шенiнен, дипломатиялық дәрежесінен немесе бiлiктiлiк сыныбынан айыру туралы ұсынуды, сондай-ақ үкiмнiң көшiрмесi мен оның заңды күшiне енгенi туралы анықтаманы жібереді.

Жазаны орындайтын мекеме немесе орган үкiмдi шығарған сотқа оның орындауға келтірілгені туралы дереу хабарлауға тиіс. Жазаны орындайтын мекеме немесе орган үкiм шығарған сотқа сотталған адамның жазасын өтеу орны туралы хабарлауға тиiс.

Егер сот ақтау үкімін шығарса не сотталуы жаза тағайындалмай сотталса немесе жазадан босатылса не бас бостандығынан айыруға байланысты емес жазаға кесілсе, ал үкім шығарылғанға дейін ол қамауда болса, осындай шешімді шығарған сот оны дереу қамаудан босатады.

Кәмелетке толмағандарды шартты соттаудың, сондай-ақ бас бостандығынан айырумен байланысты емес жазалау шараларын қолданудың, ерекше ұстау режимімен білім беру ұйымына орналастырудың не тәрбиелік ықпал етудің мәжбүрлеу шараларын қолданудың барлық жағдайларында үкімнің немесе қаулының көшірмесі үкім, қаулы заңды күшіне енген күннен бастап үш тәуліктің ішінде сотталғанның түрғылықты жеріндегі  мамандандырылған мемлекеттік органға және кәмелетке толмағандардың істері жөніндегі комиссияға жібереді.

Түзеу, қоғамдық жұмыстарға соттау, үкімнің орындалуын кейінге қалдыру, бас бостандығын шектеу туралы заңды күшіне енген үкімді орындауға беру үшін үкімнің екі көшірмесі және үкімнің заңды күшіне енуі туралы анықтама сотталғанның тұрғылықты жеріндегі қылмыстық-атқару инспекциясына сотталғанның инспекцияға келуі туралы оның қолхаты тіркеле отырып жіберіледі.

Әскер қатарына шақырылған және әскери міндетті сотталғандарға қатысты заңды күшіне енген үкімдер туралы сот отырысының хатшысы үш күн мерзімде соттың елтаңбалық мөрімен бірге судьяның қолы қойылған хатпен сотталғанның тұрғылықты жеріндегі қорғаныс істері жөніндегі аудандық (қалалық) бөлімдерге хабарлауға міндетті.

Тәрбиелік ықпал етуді арттыру мақсатында үкім заңды күшіне енген соң  қажет жағдайларда судьяның нұсқауы бойынша сотталғанның жұмыс, оқу орнына жіберілуі мүмкін.

Зейнетақы алатын және бас бостандығынан айыруға сотталған адамдарға қатысты үкімнің көшірмесі мәлімет үшін зейнетақы төлемдерін жүзеге асыратын органдарға жіберіледі.

Сотталғанның мүлкін тәркілеу және айыппұлды мемлекет пайдасына өндіру туралы үкімдер бойынша атқару құжаты, сот актісінің көшірмесі, не соттың мөрімен куәландырылған одан үзінді көшірме, және мүлік тізімдемесінің көшірмесі орындау үшін тәркілеуге жататын мүліктің орналасқан жеріндегі атқарушылық іс жүргізу органына жіберіледі. Істе мүліктің тізімдемесі болмаған кезде атқару құжаты мүлік тізімдемесі жасалмағаны туралы анықтамаларды қоса тіркей отырып, сотталғанның соңғы тұрған жеріне жіберіледі.
